The EB-1 First
Preference Employment
Based Green Card
category includes
persons of extraordinary
ability, outstanding
professors and
researchers, and
multinational business
executives.
Persons of Extraordinary
ability in the fields of
arts, sciences,
athletics, education, or
business, may qualify
for the EB-1 Green Card,
where they can establish
a record of a sustained
high level achievement,
and either national or
international acclaim.
No offer of employment
is required for persons
of extraordinary
ability. To qualify, a
person my provide
evidence that he/she
meets 3 of the following
criteria:
- The receipt of a national or internationally recognized prize or award for excellence in the field.
- Membership in an organization or association that requires their members to have demonstrated outstanding achievement.
- Published material about the applicant in major trade, professional, or scientific journals, or in other major media publications.
- Judge the work, or have been asked to judge the work of others in the field either individually or as part of a panel.
- Original scientific, scholarly, artistic, athletic, or business-related major achievements in the field.
- Authorship of scholarly articles in scientific, trade journals or in other major print media.
- In the case of an artists, the display of work at major exhibitions.
- The performance in a leading or critical role in a distinguished organization.
- The receipt of a high salary or remuneration.
- Commercial success in the field of performing arts.
To qualify in the
category of outstanding
professors and
researchers the alien
must demonstrate
international
recognition of his/her
achievements, at least 3
years of experience in
teaching or research,
and must be entering the
United States to pursue
a tenure or tenure track
research position at a
university or other
institution of higher
education. In addition,
the alien will need to
meet 2 of the following
criteria:
- The receipt of major prizes or awards for outstanding achievement.
- Membership in associations that require their members to demonstrate outstanding achievement.
- Published material in professional publications written by others about the alien's work in the academic field.
- Judged the work of other in the field, or requested to act as a judge of the work of other in the field either individually or as part of a panel.
- Original scientific, scholarly, artistic, athletic, or business-related major achievements in the field.
- Authorship of scholarly articles in scientific, trade journals or in other major print media.
To qualify in the first
preference category of
Multinational Business
Executive, the alien
must have been employed
full-time, with the
qualifying foreign
company for one year
within the preceding 3
years, as an executive
or manager, and seeking
to enter the United
States for the purpose
of working for a branch
office, subsidiary or
affiliate of the foreign
company in an executive
or managerial capacity.
To proceed with the
First Preference EB-1
case, either the U.S.
employer, or the self
petitioning alien must
file a USCIS form I-140
(Immigrant Petition for
Alien Worker), and
sufficient supporting
documentation to qualify
under the category
chosen.
